What can I do if I owe a contractor $10,000.00 balance on a $100,000.00 home he built for me.

He did not pay one contractor $2300.00 for installing the well even tho I have a cashed check from the bank showing I paid him $7,000.00 for both the well and septic tank installation. (Shown in memo on check)

He refused to accept anything less than $10,000.00 even tho he knows I paid the subcontractor 2300.00

He placed a $10,000.00 lein on my home anyway. I am taking him to small claims court.

What can I do about his lein meanwhile?

We are in valdosta, GA.

Hey booksell, I'm no lawyer, just another person trying to have their home built by a contractor. Trusted that our contractor would pay subs, gave him the checks from the bank to do so. 2 subs have filed liens so far, and we are expecting more.

You can't do much except get a lawyer. Contact your lender too, let them know what has happened. You don't have to badmouth the contractor, just tell the bank the facts about the situation, see if they can help you in anyway. Even if they can't, they will probably not approve any future construction with this builder. Hopefully this will prevent him from doing the same to someone else.
